Minor Subdivisions & Boundry Line Adjustments

Minor Subdivisions (not more than four lots involved and not creating public improvements) & Boundary Line Adjustments require a Final Plat to be prepared and submitted in accordance to the City of St. Clair’s Code of Ordinances >> Appendix B – The Land Subdivision and Mobile Home Park Regulations >> Section 3. Jurisdiction and procedure & Section 6. Final Plat and accompanying documents; for City Council review and approval prior to being recorded through the Franklin County Recorder of Deeds.  

The subdivider shall confer with the administrative officer in regard to making the proposed changes in lot boundaries, prior contracting with a Missouri Registered Land Surveyor to prepare a Final Plat. Once the administrative officer has determined that the proposal would be in compliance with City Codes and has instructed the subdivider to proceed with Final Plat preparation, the subdivider may contract with a registered land surveyor to have such plat prepared. The subdivider shall inform the registered land survey to contact the administrative officer with any questions and to submit a sketch plan to the administrative officer for review prior to final plat submittal. This sketch plan can be mailed to the administrative officer at St. Clair City Hall – 1 Paul Parks Dr. St. Clair, Mo. 63077 or emailed to: cityinspector@stclairmo.us. Once the administrative officer has completed his review of the sketch plan he/she will respond to the registered land surveyor noting any necessary changes or informing them to proceed with a Final Plat Submittal. A Minor Subdivision Application will need to be completed in full and submitted along with three registered land surveyors signed and sealed hard copies of the Final Plat and a .pdf copy emailed to the administrative officer for City Council packet preparation and a review fee paid to the City of St. Clair for $150.00 + $5 per lot.

Note: If the proposed final plat is affecting adjoining properties which are not owned by the subdivider or there are multiple owners of the same property, all owners listed on the plat shall sign and have notarized the plat prior to the subdivider or their registered land surveyor submitting the final plat and accompanying documents for review.  

Once all required documentation and fees have been submitted, the administrative officer will have the request placed on the next available Planning and Zoning Commission meeting agenda for review and consideration. The Planning and Zoning Commission meetings are held on the second Monday of every month at 7:00 p.m. in the City Councils Chambers at St. Clair City Hall. The Planning and Zoning Commission will review the request and determine if the request is in compliance with City Codes and will make and send a written recommendation to the Board of Aldermen to approve or deny such request based on their findings. The request will then be placed on the next available Board of Aldermen agenda for final review and consideration. The Board of Aldermen meetings are held on the first and third Monday of every month at 7:00 p.m. in the City Councils Chambers at St. Clair City Hall. The Board of Aldermen will review such request and if an ordinance has been prepared may approve such request by ordinance only. If an ordinance has not been prepared, then one will be prepared as soon as reasonably possible and placed on the next available Board of Aldermen agenda for consideration.

After the Board of Aldermen approves such request by ordinance, the Mayor and City Clerk are then authorized to sign and seal the ordinance and all three copies of the Final Plat when reasonably possible. After the Final Plat has been signed by the Mayor and City Clerk, the subdivider will be contacted by the administrative officer informing them that they can come and pick up the Final Plat for recording. (Note: It is the Subdivider’s responsibility to take the plat and have it recorded and to incur all costs involved and to return a recorded copy of the plat to the administrative officer for City records; failure to do so within 90 days, will render the Final Plat and City Ordnance Null and Void and the process will be required to be started all over again in order for the Final Plat to be recorded.) The subdivider shall take the Final Plat to the Franklin County Collector’s Office located at: 400 E. Locust, Union, Mo. 63084 Room 103 to be signed by the Collector stating there are no back taxes due for any of the affected properties and if taxes are due, they will be required to be paid prior to the Collector signing the Final Plat. Then the subdivider shall take the Final Plat down the hall to Room 102 to the Franklin County Recorder of Deeds Office to be recorded (recording fees will be involved). Once recorded, a recorded copy of the Final Plat shall be returned to St. Clair City Hall and submitted to the administrative officer for City records (Failure to do so will render the Final Plat and approving ordinance Null and Void!).

Duly adopted and approved this plat and has authorized the same to be filed for record
in the office of the Recorder of Deeds, Franklin County, Missouri. If this plat has not been recorded
through the Franklin County Recorder of Deeds within 90 days of the date of the approving ordinance, then this plat
shall not be allowed to be recorded and such plat and approving ordinance shall be considered Null and Void.
